Terms of Service
1. Who we are
The VisiMention service is operated under the trading name VisiMention, from Brazil. Written notice may be sent to support@visimention.com.
2. The service
VisiMention is a subscription software service that submits prompts you define to third-party AI assistants, analyses the responses, and reports how often your brand is mentioned, recommended, or cited relative to competitors you nominate.
3. Accounts
You must give an accurate email address and verify it before using the service. You are responsible for activity under your account and for keeping your credentials confidential. Organization owners are responsible for the members they invite. You must be legally capable of entering into a contract to use the service.
4. Plans, billing, and renewal
- Current prices and plan limits are published on the pricing page.
- Paid plans renew automatically each month until you cancel.
- Payments are processed by Stripe. We do not store your full card details.
- Customers in Brazil are billed in Brazilian reais; elsewhere we bill in US dollars. Prices exclude taxes that may apply where you are established.
- If a payment fails, Stripe retries it. Your plan stays active during retries and downgrades to the free plan if the subscription is ultimately cancelled or left unpaid.
- We may change prices with at least 30 days' notice by email. Changes take effect at your next renewal, and you may cancel before then.
5. Cancellation and withdrawal
You may cancel at any time. Cancellation stops the next renewal and your paid plan remains available until the end of the period already paid for; we do not pro-rate a partial month. Separately, and as required by Article 49 of the Brazilian Consumer Protection Code, a consumer who contracts a paid plan away from our business premises may withdraw within seven days of the first payment and receive a full refund. 6. Acceptable use
You agree not to:
- break the law, infringe anyone's rights, or use the service to harass or defame;
- attempt to gain unauthorised access to the service, other accounts, or the underlying infrastructure;
- resell or redistribute the service, or share seats beyond your plan's limit;
- use automated means to place load on the service beyond normal use of the interface and documented features;
- submit personal data of third parties as prompt content where you have no lawful basis to do so.
7. About the measurements
Reports are produced by sampling the output of third-party AI assistants at a point in time. Those systems are probabilistic, change without notice, and may return different answers to the same prompt. Results are therefore statistical estimates, not guarantees or statements of fact, and may contain errors. Do not rely on them as the sole basis for a business, legal, or financial decision. Any recommendation the service generates is advisory.
8. Your content
You keep all rights to the brands, prompts, notes, and other content you put into the service. You grant us the limited licence needed to host and process that content to run the service for you, including transmitting prompts to the AI providers listed in our privacy policy. We do not sell your content, and we do not use it to train our own models.
9. Availability
We aim to keep the service available but do not promise uninterrupted operation. The service depends on third-party AI providers whose availability, pricing, and behaviour are outside our control; a provider becoming unavailable may reduce or delay reporting. We may suspend access for maintenance or to protect the service, and will give notice where practical.
10. Liability
Nothing here limits liability that cannot be limited under Brazilian law, including our obligations under the Consumer Protection Code. Subject to that, our total liability arising out of the service in any twelve-month period is limited to the amount you paid us during that period, and we are not liable for indirect or consequential loss, lost profits, or lost business opportunity.
11. Suspension and termination
You may stop using the service and delete your account at any time. We may suspend or terminate an account that breaches these terms or that we are legally required to act against, with notice where practical. On termination, your right to use the service ends; the privacy policy governs what happens to your data.
12. Changes to these terms
We may update these terms. If a change materially affects your rights, we will give at least 30 days' notice by email before it takes effect. Continuing to use the service after that means you accept the new terms.
13. Governing law
These terms are governed by the laws of the Federative Republic of Brazil. Where you contract as a consumer, you may bring proceedings in the court of your domicile, as the Consumer Protection Code provides.
